Stargate mod, important!

Recommended Posts

Im having a hard time believing this... i think the most that could happen would be a request for the website to be taken down if the considered copywrighted content isnt removed, i dont see enough violation to justify (international?) legal action. Does this BS even stand in good olle EU? How are international trademark violations handled?

Edit: Interesting:

Quote[/b] ]International trademark laws

It is important to note that although there are systems which facilitate the filing, registration or enforcement of trademark rights in more than one jurisdiction on a regional or global basis (eg. the Madrid and CTM systems, see further below), it is currently not possible to file and obtain a single trademark registration which will automatically apply around the world. Trademark laws are territorial in nature and generally apply only in the applicable country or jurisdiction, a quality which is sometimes referred to as ‘territoriality’.

Time to sleep but if someone is curious...

http://en.wikipedia.org/wiki/Trade_mark_law_of_the_European_Union

Bluffing, i think the MGM layers have more important things to handle than this.

This world where every little thing may cause legal proceedings makes me sick... banghead.gif  you should charge them the same amount of money for advertising their "stargate brand name" in our community...

I hope Napoleon's and Wellington's lawyers will not sue me...  yay.gif

@ Oct. 26 2006,22:07)]Could ofp.info get dragged into this too?

Most certainly.. I'm actually surprised that they haven't removed all the Stargate mod entries. This will get them in trouble.

@Heatseeker

It's pointless to question whether it's justified or not. I am sure that the MGM lawyers knows their stuff enough to take you to court. As I said no normal person could afford such a thing. I'm quite sure that no lawyer would advice you to take it that far. So in the end you would be forced to pay MGM so they wont take you to court + that you would have to pay your lawyer fee. I suppose the total cost would be a few thousand dollars if you're lucky.

If you're the one being prosecuted (sp), most countries give you a lawyer if you can't afford one.

Right?

lol - this lawyer you can consider as somebody who

translates you the acusations they putting towards

to you and that they're doing right so.

Do you think that these default lawyers can mess with

a professional lawyer or that he even tries to?

Well maybe in Hollywood but not in real life - who pays

more = who wins. wink_o.gif

Been doing some reading... looks like MGM has shut down some mods based on the Stargate thing for lots of games. Even a "Fargate" mod using Far Cry, ofcourse the mods wont face the threat of this giant... who would/could?

But the way they are forcing and threatening fans might give them a bad name, these mods were being made by fans for top selling multi million selling franchises, like HL2, Far Cry, Brothers in Arms and other popular games. I dont think they would apretiate the negative press in the gaming media.. since they will be releasing a... game.

A Stargate game is in development (using Epics UT3.0) but the screens looked shitty to me.

I think they are doing their part but i doubt they would go forward with this unless their idiots, if they are about to release the result of a very significant investment, the last thing they would want are articles on popular gaming media sites stating that some fans were threatned with legal action because they made stargate inspired mods..

if anything the members of the community who made the stargate mod should be proud that MGM feel endangered if this is a new game their preparing for. They see the high quality of the work and see that it could cause some damage to their sales. Mind you I trualy think companies who do this to modding communities are just sadacts who can do nothing but act bigger, hell if they knew you could hire a better lawyer than theirs theyd back off straight away tounge2.gif

This is an unusual and interesting development.

Q : Was OFPC at any time hosting SGM, or providing mirrors to SGM data, or was there only links to files stored on systems not under OFPC's control?

Doesn't this just come down again to the fact that at least in the US if someone owns a trademark he needs to 'defend' it actively or he will lose it??

At least it was something like that a few years back when Toadlife was getting into trouble with his Operation LoJack mission..

From that thread..

Quote[/b] ]In US Trademark law, you have to actively enforce your trademark (i.e. like this situation) or you lose all rights to that trademark. This enforcement is regardless of whether commercial intent is involved.

Of course that might have changed overt past two years...

What I find funny in this thread is people blaming lawyers for this icon_rolleyes.gif

ot: well there is a long way for you to master the art of bitching and black humor biggrin_o.gif

anyway, i use DB9 on purpose

we didnt blaming the lawyer(as)s, since we all know about the trademark thing, just because the fact while they keep yelling someone break trademark laws, they simply cant make a good enought game and profit from that, which is even more pointless for me(well there is an old chiness saying about that, but i am too lazy to translate it), but well, thats how the world works and i have done my bitching, so its better to shutup bf mods give me a little box confused_o.gif

They already did it to one company so said company scrapped the hmmwv's and used something else, interesting that said company is even a U.S. based one.

wtf??? what i dont understand is why you should bring them a list of sites that refer to the stargate mod. if i park my car illegal do i have to know all other illegal parked cars in town and tell them the police? What do you have to do with the other community pages?

thats rubbish and i think they use their mighty we will sue you till the rest of your days behavior to make you, and your community knowledge, doing their work.

Same thing that you are not allowed to post a copy of that letter.

Why not? cause the trial is still pending? This stinks.

I really understand your panic and fear Mr. Burns, dont get me wrong, but no lawyer has the right to make you to an informer for his case, specially not when its done with extorting methods.

I agree with you, still can´t understand how such demands can be valid .. but the lawyers know how to earn their $´s, that´s for sure confused_o.gif
