whats the deal on porting models from other games?

Im making a unique-to-me artistic representation.

No I dont because i am not stealing thier IP. Im making a unique-to-me artistic representation. Im not taking their product and modifying it. Im looking at pictures, and translating what i see into a unique 3D model which is a representation that does not undermine thier Interlectual Property or business.

I read that if games makers (and presumably mod makers) are making content of historical significance then IP laws don't apply in the likeness. (US law) I don't know the ins and outs but the guy that made IL-2; Oleg Maddox, received a lawsuit from Northrupp Grumman over some of the US planes in his Pacific Fighters expansion.

However, he didn't understand US law and shit himself so he signed an agreement that basically meant Maddox games could never use another NG plane in them (and made some pretty hefty financial compensation from what I can gather).

It turned out that NG's case was bollocks and he could have told them to fuck off, but the agreement was already signed.

From what I understand, it's okay to make the likeness of military weaponry/equipment but if they have copyrighted the name (like Trijicon did), then you have to respect the copyright on the name and either pay them money to use it or make up some other name (like BIS do on Land Rover Offender for example).

This is all under US law and I'm pretty sketchy on the legal details (as I'm not a legal minded person) but that's what I got from the info.
