And while it is legal to use deadly force in some places in order to prevent simple burglary, it is generally accepted that the use of deadly force requires the presence of a clear and immediate threat of death or serious injury to yourself or a third person. If someone entered my home looking to steal my TV, I would certainly confront that person and cuff him, but I would not shoot him unless required to. RedRogue 0 Posted June 23, 2002 If you are going to shoot someone breaking into your home in a buglary attempt, saddly you better shoot to kill. Because like Mr. Frag said a Firearm always constitues intent with deadly force. So if you injure and attempted burglar he can sue and odds are win for medical bills and pain&suffering because unless they are threatening bodily harm you cannot legally use deadly force to stop them. timmy 0 Posted June 23, 2002 i heard that a guy robbed a hotel or somthing, and on his fast get away out of the parking lot, he ran into a post and wrecked his car. then he sued the place he robbed for not catching him, and having too lax security and won. LBGS_Stewart 0 Posted June 23, 2002 about two years ago i think this was in WI,USA a person broke into a house and a statue feel on him and he sued the owner and won. this is a Sad fact in america, makes me think who has more rights the rober or the civ. no sence in protecting your self or trying to, the robber will win the cort case. you shoot him you will most likly get sued and lose something happens to him on your land must likly get sued and lose. call the cops and he rob some stuff, he gets picked up prosicuted and you may not get your stuff back. so you lose Share this post Link to post Share on other sites

I can guarantee you that these days, you would be slapped with a wrongful death lawsuit.
