E.P.S.M. was blocked

Good day to all! 

 

Go to the essence. I am the one of developer of the modification E.P.S.M. Exomod. Yesterday the mod was blocked on the steam workshop. It has been said that we used the mod for commercial purposes and took the money. Also we are "stealing content". 

 

But why? We never take even a donation, and used the models only for our mod. There were no complaints from the original developer (Sledghammer) or the publisher (Activision). Mod was available throughout the year in steam workshop. Somebody can tell what did we do wrong? By this logic, you can ban other mods, because they too are "stealing content". I hope someone will respond.

But you didn't have permission from Activision or Sledghammer, did you?  Even if you aren't accepting donations, you are still taking their models and using them in your mod without permission (stealing).  That is what's wrong with it.  Yes, by that logic, other mods can and should be banned (that was the whole point of the large bans a couple of days ago).  Unfortunately, Steam Workshop has a lot of problems with users re-uploading mods and it takes a lot of community awareness to enforce IP rights and flag mods for takedown, meaning that stolen content isn't always flagged.

You may not be using it for commercial purposes, but your mod was using content from another game without permission which is stealing. I assume you didn't read the steam license rules when uploading the content. 

 

Which is why your content was removed from Armaholic and these forums previously.

Its very easy, as R0adki11 already mentioned:
What you did wrong was: agreeing to the steam licenses without reading them... (as unfortunatelly most don't do).

 

Here is the relevant part you missed and disobeyed from Steam Subscriber Agreement :

D. Representations and Warranties

You represent and warrant to us that you have sufficient rights in all User Generated Content to grant Valve and other affected parties the licenses described under A. and B. above or in any license terms specific to the applicable Workshop-Enabled App or Workshop page. This includes, without limitation, any kind of intellectual property rights or other proprietary or personal rights affected by or included in the User Generated Content. In particular, with respect to Workshop Contributions, you represent and warrant that the Workshop Contribution was originally created by you (or, with respect to a Workshop Contribution to which others contributed besides you, by you and the other contributors, and in such case that you have the right to submit such Workshop Contribution on behalf of those other contributors).
 

You furthermore represent and warrant that the User Generated Content, your submission of that Content, and your granting of rights in that Content does not violate any applicable contract, law or regulation.

 

That means the following just in a very short, not complete overview:

- you did not have the sufficent rights on the models (as you did not ask Activion etc and therefore where not granted those rights)

- this means you did violate the regular rights for intellectual property

- the content you uploaded was not originally from you (as it was from Activision)

 

So its not about taking money or something, its about using content without having the right to do so. And yes unfortunatelly there are many others that do the same for their life-mods or "uploading for better accessability" etc. without having the right to do so. Sadly the orginal mod-creators have to look on their own for those violations and report them...

Closing - the only way the EPSM Mod will be permitted to be on this forum or other sites is to have original created content in the mod.
